“Client” means any person who requests the Services of Forenzix, makes Information available to Forenzix for the specific purpose of data analysis and/or reporting at that Client’s request and any person that requests advice or assistance in relation to their client relationship management software, be that the configuration functionality or otherwise.

“Information” means any and all Personal Dataincluding all text, files, images, photos, video, sounds, or other materials in the form of PDF, JPEG or other format uploaded to a database accessible by Forenzix or otherwise made available to Forenzix for the purpose of carrying out a Service.

"Personal Data" as defined in our Privacy Policy.

“Service” or “Services” means any procedure or service that is provided by Forenzix to Clients as well as Users which includes but is not limited to data analysis and/or reporting at a Client’s request and requests for advice or assistance in relation a Client’s client relationship management software be that the configuration of such, the functionality or otherwise.

“Users” means all users of the Website and any person given access to use of the Web App.

“Website” means the website https://www.forenzix.co.uk/ and all the pages, content and sub-domains contained therein.

“Web App” means our website application available on the domain: https://forenzicswebapp2-sandbox.mxapps.io/login.html or such other Uniform Resource Locators (“URLs”) provided to Users by us along with log in details to give access to the Web App.

Governing Law & Jurisdiction

3. These Terms and Conditions will be bound by and interpreted in accordance with English law. Disputes arising in connection with these Terms and Conditions will be exclusively subject to the jurisdiction of the English courts. If any provisions within this agreement are deemed illegal or unenforceable, such provisions will be separated, and the rest of the agreement will continue to be in full force and effect.


Overview

4. Forenzix provides a range of services in the analytical and reporting field of which some are available via our Web App. Forenzix also offers advice and assistance towards establishing and maintaining client relationship management software as well as general practice management software.


Accuracy of Information

5. Forenzix creates reports based on Information provided by Clients as well as other third parties. Although we attempt to ensure that the data we provide in our Services is correct and accurate, because this data is derived from external sources, Forenzix cannot guarantee the accuracy of the data it provides in its fulfilment of a Service. Forenzix therefore cannot be held liable for any problems or losses arising from errors in any reports produced by Forenzix Limited where inaccurate Information was provided from an external source.

In using the Services provided by Forenzix, you acknowledge that Forenzix is not acting as an agent or a contractor and is not responsible for securing any litigation funding or other services associated with litigation processes. It is Client’s sole responsibility to adhere to and meet the requirements of their associated parties in the litigation process.

Information made available to Forenzix

7. You agree to use both the Website and the Web App solely for lawful purposes, ensuring that your use does not violate the rights of any individual or any applicable laws.

8. You understand that all Information uploaded to any database operated by Forenzix or that Forenzix is given access to, is the sole responsibility of the person from whom such Information originated or in this case the Client and/or the User. You are entirely responsible for all Information that you upload, email or otherwise make available via the Service as either a User or a Client or as both. In doing so, you also thereby make available this Information to Forenzix to use via a licence of use in accordance with our Privacy Policy.

9. From time to time, the Forenzix Website and the Web App may contain links to other websites, which are completely independent of Forenzix. Forenzix makes no representation or warranty as to the accuracy, completeness or authenticity of the contents of such websites.

10. Linking to any other websites is done at your own risk. You acknowledge that you are responsible for evaluating and assuming all risks associated with linking to other websites. Under no circumstances will Forenzix be held liable for any loss or damage of any kind incurred as a result of linking to other websites.


Intellectual Property

11. Forenzix owns all the intellectual property rights relating to the Website and the Web App including the database, layouts, designs, text, and graphics, and you agree not to use or copy any part thereof without our express permission.

All intellectual property rights to Information that Users or Clients upload to any databases owned and operated by Forenzix are retained by the rightful copyright owner, and these are added to those databases by Users or Clients at their own risk. By doing so, you are giving Forenzix explicit permission to store, display, recreate and use that Information as data for the purpose of recreating and displaying it in calculations and reports as part of the Service, in accordance with the terms outlined in our Privacy Policy.

Dealings with Referred Third Parties

13. Your interactions with any organisations and/or individuals (“Referred Third Parties”) found on or through our Website, our Web App or introduced to you by us, are solely between you and such organisations and/or individuals.

14. You agree that Forenzix shall not bear any responsibility or liability for any loss or damage of any nature incurred as the result of a dealing between you and any Referred Third Parties. If there is a dispute between Users, Users and Clients or Clients and any Referred Third Parties, Forenzix is not obligated to become involved.

In the event that you have a dispute with one or more other Users, Clients or any Referred Third Parties, you hereby release Forenzix, its officers, employees, agents and successors in rights from any claims, demands and damages (actual and consequential) of every kind or nature, whether disclosed and undisclosed, known or unknown, suspected and unsuspected, arising out of or in any way related to such disputes.


Limitations

16. You acknowledge that Forenzix has the authority to set limitations on the use of the Web App, including but not limited to the duration that Information made available to Forenzix will be retained by Forenzix, and the frequency with which you may access the Web App.

17. You agree that Forenzix is not responsible or liable for the deletion or failure to store any Information made available to Forenzix. Additionally, you acknowledge that Forenzix reserves the right, at any time, to modify or discontinue the Web App (or any part thereof) with or without notice, and Forenzix shall not be held liable to you or any third party for any modification, suspension, or discontinuance of any of the Services.

18. You agree that Forenzix shall not be liable for any loss or damages arising from the provision (or non-provision) of any part of the Service, including loss of profit or consequential loss or damage.


Termination of Service

19. You agree that Forenzix, at its sole discretion, reserves the right (but is not obligated) to block your email address, or terminate or restrict your access to or use of the Web App immediately and without notice, for any reason. This includes, but is not limited to, situations where Forenzix believes that you have acted inconsistently with the terms outlined herein.

20. You agree that Forenzix shall not be liable to you or any third-party for any termination or restriction of your access to the Web App. You agree not to attempt to use the Web App after said termination.

21. Forenzix reserves the right to change or update these Terms and Conditions from time to time. As a User, you are responsible for acknowledging any updates of these Terms and Conditions by visiting this section. Any significant changes to these Terms and Conditions will be communicated through notification emails to all active Users and Clients.
